Please read these Terms and Conditions carefully. By booking a tour or travel package with Webtours Getaways cc – (“JustHoneymoons”, “JustSki”, “BeachTravel”, “ILoveTravel”, “we,” “us,” or “our”), you signify your agreement to these terms on behalf of yourself and all persons under your authority. These terms constitute a legally binding contract between you and Webtours Getaways cc.

Booking and Payment

Binding Authority: The client making the booking warrants that they have the authority to do so on behalf of all travellers listed. All individuals in the booking are bound by these terms as if they had made the booking themselves.
Bookings are confirmed: Upon receipt of written confirmation from Webtours Getaways CC. No verbal confirmations are binding
Deposit: A non-refundable deposit of R4,000 per person or 25% of the total package value, whichever is higher, is required within 24 hours of receiving our booking confirmation invoice.
The amount of the deposit and payment dates are prescribed by our operators in your written confirmation. Bookings are not secured until this deposit is received.
Final Payment: The full amount due must be paid no less than eight weeks (8 weeks) prior to the departure date, unless otherwise specified by our operator. For bookings made within eight weeks of departure, full payment is due immediately. During peak seasons, full payment is due 12 weeks prior to departure.
Consultation Fee: A non-refundable consultation and travel assist fee of R517.50 (inclusive of VAT) is due on each confirmed booking and will be invoiced separately.
Price Fluctuation: Prices are subject to change until full payment is received. We reserve the right to increase the tour price due to fluctuations in foreign exchange rates, airline costs, fuel levies, airport taxes, or any other related supplier costs. You will be responsible for any such incremental costs if your payment is not made within the specified timeframe. Once airline tickets are issued, there is no additional charge for this portion of your travel experience.
Payment Methods: Prices are based on payment by direct bank transfer (EFT) or bank deposit. Credit card payments are not accepted directly by us. Some operators are subject to a 3.5% levy if processed through our operators.
Bank Fees: Any bank fees associated with cash transfers must be included in your cash payment.

Cancellations and Amendments

Client Cancellation: All cancellations must be made in writing. Cancellation charges are levied in accordance with the rates from our operators and may be up to 100% of the total cost, in addition to a Webtours Getaways cc consultation and service fee.
Cancellation Fees:
- Land Arrangements: The full deposit is forfeited for cancellations made at any time up to eight weeks prior to departure. Additional charges may apply.
- Air Arrangements: Once air tickets are issued, cancellation fees for air tickets, airport taxes, and fuel surcharges vary from 25% to 100% of the cost.
Amendment Fees: We reserve the right to charge an amendment fee of at least R517.50 per person for any changes made to a confirmed booking, including but not limited to date changes and itinerary amendments.
No-Shows: If you fail to join a tour or use any booked services for any reason, no refund will be issued and no liability will be accepted by us.

Our Role and Limitation of Liability

Role as Agent: Webtours Getaways cc acts solely as an agent for third-party suppliers, including but not limited to airlines, hotels, tour operators, and transport companies. We are not liable for any loss, damage, injury, death, or any other claim that may arise from the acts or omissions of these third-party suppliers. The airline ticket, once issued, constitutes the sole contract between the airline and the passenger.
Right to Cancel or Amend: We reserve the right to cancel any tour prior to departure. In such an event, our liability is limited to a refund of all amounts received from you at that time. We are not liable for any further claims. We also reserve the right to make minor changes to the itinerary without notice, provided the overall nature of the tour is not substantially altered.
Exclusion of Liability: We are not responsible for any loss, damage, or injury caused by events beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, political unrest, civil strife, strikes, riots, or any other event of force majeure.

Your Responsibilities

Travel Documents: You are solely responsible for ensuring you have a valid passport, visa, health certificates, and any other necessary travel documents for your entire journey. Webtours Getaways cc will assist you to the best of our ability, but assumes no liability for any issues arising from incorrect or insufficient documentation.
Insurance: Travel insurance is compulsory for all bookings. It is your responsibility to arrange adequate cancellation, medical, baggage, and personal insurance. We are not liable for any costs incurred as a result of your failure to obtain appropriate insurance coverage.
Compliance: You agree to comply with all laws, rules, and regulations of the countries you visit, as well as the requirements of all suppliers (e.g., airlines, hotels).

Waiver and Indemnity

By booking a tour, you acknowledge that travel may involve inherent risks, and you agree to execute a waiver of rights as an integral part of this contract. You (and your heirs, executors, and assigns) irrevocably waive and abandon all rights and claims against Webtours Getaways cc for any damage, injury, or loss of any nature arising from your tour. You also agree to indemnify, hold harmless, and absolve Webtours Getaways cc from any such claims.

General

Entire Agreement: These terms and conditions, along with your booking confirmation and final invoice, constitute the entire agreement between you and Webtours Getaways cc.
Governing Law and Jurisdiction: This contract shall be governed by the laws of South Africa. You consent to the non-exclusive jurisdiction of the High Court of South Africa for any disputes.
Severability: If any provision of these terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
